Abstract

Tindak pidana korupsi bisa diminimalisir dengan beberapa cara, salah satunya dengan membangun kerjasama dengan penegak hukum yang menjadi saksi tetapi saksi tersebut juga merupakan pelaku yang bekerja sama dalam tindak pidana tersebut (Justice Collaborator). Penulis menggunakan metode penelitian normatif. Penelitian ini bersifat perspektif ditinjau dari UndangUndang Nomor 31 Tahun 1999 juncto Undang-Undang Nomor 20 Tahun 2001 Tentang Pemberantasan Tindak Pidana Korupsi, Undang-Undang Nomor 13 Tahun 2006 juncto Undang-Undang Nomor 31 Tahun 2014 tentang Perlindungan Saksi dan Korban, SEMA Nomor 4 Tahun 2011 dan beberapa peraturan lainnya. Teknik pengumpulan bahan hukum yang digunakan dalam penulisan skripsi ini adalah studi kepustakaan atau studi dokumen. Tujuan dalam penelitian ini ialah untuk menganalisis pemidanaan oleh hakim terhadap terdakwa justice collaborator yang dalam putusannya menjatuhkan sanksi dibawah ketentuan pidana minimum khusus. Dalam Putusan Nomor: 151/Pid.Sus/2015/PN.Jkt.Pst dimana terdakwa mendapatkan status sebagai justice collaborator oleh hakim dan pemidanaan terhadap terdakwa pidana penjara selama 2 (dua) tahun. Terdakwa dipidana Pasal 6 ayat (1) huruf a UU PTPK terdapat ketentuan pidana penjara paling singkat 3 (tiga) tahun dan paling lama 15 (lima belas) tahun. Hakim menjatuhkan putusan tidak sesuai dengan ketentuan minimum khusus yang tertera dalam UU PTPK. Terdakwa mendapat sebutan Justice Collaborator oleh penunut umum, itulah salah satu alasan hakim menjatuhkan pidana terdakwa dibawah ketentuan minimum khusus. Putusan dibawah ketentuan minimum khusus oleh hakim sepatutnya tidak dilakukan karena hakim tidak dapat menjatuhkan putusan yang bertolak belakang dengan apa yang ada di dalam undang-undang. Pedoman pemidanaan mengenai justice collaborator di Indonesia hingga saat ini belum ada peraturan yang tegas. Oleh sebab itu, masih terdapat perbedaan dalam penjatuhan pidana antara terdakwa yang bekerjasama dengan pihak penegak hukum dan yang tidak. Kata Kunci : Penegakan Hukum, Justice Collaborator, Tindak Pidana Korupsi. / One way that a criminal case, especially a criminal act of corruption, can be resolved is by collaborating with law enforcement, namely by becoming a witness to the perpetrator who cooperates or is often known as a Justice Collaborator. In this research the author used normative research methods. This research is perspective based on Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 concerning the Eradication of Corruption Crimes, Law Number 13 of 2006 in conjunction with Law Number 31 of 2014 concerning the Protection of Witnesses and Victims, SEMA Number 4 of 2011 and several other regulations. This research aims to analyze the punishment of justice collaborator defendants by judges in imposing sentences based on special minimum criminal provisions. The technique for collecting legal materials used in writing this thesis is literature study or document study. The result of this research is that Decision Number: 151/Pid.Sus/2015/PN.Jkt.Pst where the thief was given the status of a justice collaborator by the judge in sentencing him to imprisonment for 2 (two) years. The Judge's decision is not in accordance with the special minimum provisions contained in the PTPK Law. In fact, in Article 6 paragraph (1) letter a of the PTPK Law which was decided by the judge regarding fraud, there are provisions for minimum and maximum sentences. One of the judge's considerations in imposing a sentence based on special minimum provisions is that the perpetrator is given justice collaborator status by general action. The information provided by the defendant is considered significant and helps uncover this criminal act of corruption. Seeing that the judge's decision is based on special minimum provisions, this should not be done by the judge, considering that the judge cannot give a decision that is contrary to what is contained in the law. Until now in Indonesia there are no clear sentencing guidelines related to the punishment of justice collaborators. So there are still differences between fraud convictions and those with status as a justice collaborator. Keywords: Law Enforcement, Justice Collaborator, Corruption Crimes
