Abstract

Penelitian ini bertujuan untuk mengetahui penerapan hukum pidana materil terhadap pelaku tindak pidana dalam perkara putusan No . 2802/Pid.B/2015/PN.Mdn dan untuk mengetahui pertimbangan hakim dalam menjatuhkan putusan sudah tepat atau belum dan sudah sesuai dengan fakta-fakta serta keteragan-keterangan saksi yang dihadirkan dalam persidangan. Metode penulisan yang dipergunakan dalam penulisan skripsi menggunakan metode deskriptis, artinya suatu penelitian yang fokus kajiannya menitik beratkan pada asas�asas hukum, kaidah-kaidah hukum dan aturan hukum yang terdapat dalam berbagai ketentuan peraturan perundang-undangan yang berlaku maupun teori-teori hukum yang tersebar dalam berbagai litaratur. Hal ini dalam rangka menganalisis secara deskriptis Analisis Tindak Pidana Kekerasaan Dalam Rumah Tangga( Putusan No 2802/Pid.B/2015/PN.Mdn) Dalam proses pengambilan keputusan dalam perkara Putusan No 2802/Pid.B/2015/PN.Mdn Majelis Hakim sudah sesuai dengan aturan-aturan hukum yang berlaku. Karena sebelum menjatuhkan Putusan Majelis Hakim sudah mendengarkan keterangan saksi- saksi dan keterangan terdakwa dan barang bukti pun sudah dibawa dalam persidangan. Majelis Hakim juga tidak hanya mempertimbangkan dakwaan primair dan dakwaan subsidair, tetapi Majelis Hakim juga mempertimbangkan beberapa faktor lain dan juga keterangan saksi yang meringankan serta fakta-fakta dalam persidangan. Sehingga dalam menjatuhkan putusan, Majelis Hakim sudah sesuai dengan semua fakta dalam persidangan dan apa yang di perbuat oleh terdakwa. / This research aims to determine the application of material criminal law to criminal offense in penalty case No. 2802/Pid.B/2015/PN.Mdn and to find out whether the judge's considerations in making a decision were correct or not not yet and is in accordance with the facts and statements of the Witness presented at the conference. The writing method used in writing a thesis uses the method descriptive, meaning research whose focus focuses on legal principles, legal principles and legal rules contained in various provisions of applicable laws and regulations and legal theories used in various literature.
