Abstract

ku kekerasan dalam dunia maya atau cyberbullying. Rumusan masalah dalam penelitian ini adalah bagaimana perlindungan hukum bagi korban tindak pidana perundungan berdasarkan peraturan perundang-undangan dan bagaimana penerapan pidana terhadap pelaku tindak pidana perundungan di dunia cyber space (cyber bullying in cyber space) studi kasus putusan nomor 68/Pid.Sus/2019/Pn.Smn. Metode Penelitian yang digunakan adalah yuridis normatif, dengan menggunakan data sekunder berupa bahan hukum yang terdiri dari bahan hukum primer, sekunder, dan tersier. Berdasarkan hasil penelitian dan analisa penulis maka perlindungan hukum bagi korban tindak pidana perundungan berdasarkan peraturan perundang-undangan diatur dalam pasal 310 KUHP Jo. Pasal 27 ayat (3) dan Pasal 28 Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang tentang perbuatan yang dilarang Jo. Pasal 45 Undang-Undang ITE terntang penerapan pidana terhadap pelaku tindak pidana perundungan di dunia Siber (Cyber Bullying in cyber space). Penerapan pidana terhadap pelaku tindak pidana perundungan di dunia cyber space (cyber bullying in cyber space) studi kasus putusan nomor 68/Pid.Sus/2019/Pn.Smn kasus berdasarkan analisa penulis Hakim sudah tepat dalam melindungi korban dengan Pasal 27 dan 29 UU ITE dalam memberikan putusan yang diatur dalam peraturan perundang�undangan tersebut. / The widespread use of social media has a negative effect, namely the birth of violent behavior in cyberspace or cyberbullying. The formulation of the problem in this research is how is legal protection for victims of criminal acts of bullying based on laws and regulations and how is the implementation of criminal acts against perpetrators of criminal acts of bullying in cyber space (cyber bullying in cyber space) case study decision number 68/Pid.Sus/2019 /Pn.Smn. The research method used is normative juridical, using secondary data in the form of legal materials consisting of primary, secondary, and tertiary legal materials. Based on the results of the author's research and analysis, the legal protection for victims of criminal acts of bullying based on the legislation is regulated in Article 310 of the Criminal Code Jo. Article 27 paragraph (3) and Article 28 of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning actions that are prohibited by Jo. Article 45 of the ITE Law concerning the application of criminal acts against perpetrators of bullying in cyberspace (Cyber Bullying in cyber space).
