Abstract

Tujuan penelitian ini adalah untuk mengkaji penyebab dari lemahnya fungsi legislasi Dewan Perwakilan Rakyat Republik Indonesia (DPR RI). DPR RI dinilai tidak maksimal dalam menjalankan fungsi legislasi padahal kewenangan yang diberikan kepada DPR sudah sangat besar setelah adanya amandemen UUD 1945. Penelitian ini dilakukan secara yuridis-normatif dengan penyajian data secara deskriptif, dan analisis kualitatif dengan menggunakan metode deduktif yaitu dengan menguraikan hal yang bersifat umum menuju ke hal yang bersifat khusus. Data yang digunakan dalam penelitian adalah berupa data yang diperoleh dari bahan-bahan pustaka. Berdasarkan hasil penelitian ada beberapa hal yang yang menyebabkan lemahnya fungsi legislasi DPR RI, disamping karena regulasi pengaturan pembentukan Undang-undang yang tidak memaksa untuk lembaga legislatif berkinerja maksimal, juga karena motivasi dan komitmen moral dari anggota DPR RI yang dinilai masih minim hal demikian diakibatkan tidak adanya keseriusan dari anggota DPR RI untuk memperbaiki tata hukum di Indonesia sebagai akibat dari pengaturan dari perekrutan bakal calon anggota DPR RI yang masih buram, akibatnya masyarakat disediakan pilihan bakal calon anggota DPR RI yang belum tentu teruji kapasitas dan kapabilitasnya. / The purpose of this study is to examine the causes of the weak functioning of the legislature of the Indonesian House of Representatives (DPR RI). The DPR RI is considered not optimal in carrying out the legislative function even though the authority granted to the DPR has been very large after the amendment of the 1945 Constitution. This research was conducted in a juridical-normative manner by presenting data descriptively, and qualitative analysis using a deductive method that is by describing general things leading to specific things. The data used in the study are in the form of data obtained from library materials. Based on the results of the study there are a number of things that cause the weakness of the legislative function of the DPR RI, in addition to regulations governing the formation of laws that do not force the legislative body to perform optimally, also because of the motivation and moral commitment of members of the DPR RI which are considered to be minimal. the seriousness of members of the DPR RI to improve the legal system in Indonesia as a result of the regulation of the recruitment of prospective candidates for DPR RI who are still opaque, as a result the community is provided with the choice of prospective members of the DPR RI whose capacity and capabilities have not been tested.
