Abstract

Skripsi ini merupakan penelitian yang fokus pada analisis yuridis terhadap kedudukan hukum dan peran Artificial Intelligence (AI) dalam Sistem Hukum Acara Perdata Indonesia. Dengan mengikuti perkembangan teknologi AI, penelitian ini mengeksplorasi perlunya regulasi yang sesuai dengan kemajuan tersebut dalam hukum acara perdata. Definisi AI sebagai teknologi yang meniru perilaku manusia menjadi fokus penelusuran terhadap kemampuan AI dalam tindakan hukum dan dampaknya terhadap sistem hukum. Meskipun Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik telah ada, penelitian ini menyoroti kebutuhan akan pembaruan untuk mengakomodasi kemajuan AI. Selain itu, skripsi ini melakukan perbandingan penggunaan AI dalam hukum acara perdata di Indonesia dengan negara lain. Penelitian membahas tantangan dan potensi dampaknya, termasuk aspek etis dan pertimbangan hukum internasional tentang kendali manusia atas teknologi tersebut. Fokus tidak hanya pada aspek regulasi, melainkan juga dampak praktis penggunaan AI dalam hukum acara perdata, termasuk validitas dan kredibilitas bukti, prosedur hukum, serta ketidakpastian dan keamanan data. Skripsi ini juga menyoroti perlunya regulasi AI sebagai subyek hukum, dengan saran untuk melakukan perubahan atau penambahan pada peraturan hukum yang ada, khususnya terkait tanggung jawab AI dalam perbuatan hukum. Penelitian ini menegaskan bahwa regulasi AI dapat memberikan panduan konkret bagi pengembang dan pengguna AI, sesuai dengan kemajuan teknologi kecerdasan buatan di sektor hukum Indonesia. Sebagai kesimpulan, skripsi menekankan bahwa regulasi khusus diperlukan untuk mengelola peran AI dalam hukum acara perdata, dengan pentingnya harmonisasi dengan prinsip-prinsip hukum internasional. Perlindungan data, pelatihan, dan kerja sama antar stakeholder diidentifikasi sebagai kunci untuk memanfaatkan potensi positif AI sambil menjaga prinsip keadilan, etika, dan hak-hak individu dalam sistem hukum acara perdata Indonesia. Kata Kunci: Artificial Intelligence, Hukum dan AI, Kedudukan Hukum AI, Sistem Hukum Acra Perdata, Hukum Indonesia, Peran AI. / This thesis is a research that focuses on the juridical analysis of the legal position and role of Artificial Intelligence (AI) in the Indonesian Civil Procedure Law System. By following the development of AI technology, this research explores the need for appropriate regulations in accordance with these advances in civil procedure law. The definition of AI as a technology that mimics human behavior becomes the focus of the exploration of AI's capabilities in legal actions and its impact on the legal system. Although Law No. 19/2016 on the Amendment to Law No. 11/2008 on Electronic Information and Transactions already exists, this research highlights the need for updates to accommodate AI advancements. In addition, this thesis compares the use of AI in civil procedure law in Indonesia with other countries. The research discusses the challenges and potential impacts, including ethical aspects and international legal considerations on human control over such technology. The focus is not only on the regulatory aspects, but also the practical impacts of using AI in civil procedure law, including the validity and credibility of evidence, legal procedures, and data uncertainty and security. This thesis also highlights the need for regulation of AI as a legal subject, with suggestions for changes or additions to existing legal regulations, particularly regarding the liability of AI in legal actions. This research confirms that AI regulation can provide concrete guidance for AI developers and users, in accordance with the advancement of artificial intelligence technology in Indonesia's legal sector. In conclusion, the thesis emphasizes that specific regulations are needed to manage the role of AI in civil procedure law, with the importance of harmonization with international legal principles. Data protection, training, and cooperation between stakeholders are identified as key to harnessing the positive potential of AI while maintaining the principles of fairness, ethics, and individual rights in Indonesia's civil procedure law system.
