Abstract

Human rights are the rights inherently attached to everyone since his birth. Right to health services is one of the rights derived from human rights. Human rights principles are to be the basis of health services. The principles generally found in every international convention dealing with human rights are also to be the basis of health services, including three main principles, namely equality, non- discrimination and state obligations principles. The right to health services is a basic right that must be possessed by everyone including the people with mental disorders (ODGJs). The ODGJs have the same opportunity to get health services through the provision of mental health facilities, mental health workers, mental health supplies by the government. This study used a normative-juridical approach with analytical-descriptive specification. The data used were secondary data through library studies. Human rights principles in health services for ODGJs were based on moral values, among others, respect for autonomy, non-maleficence, beneficence, and justice. These principles and values were stated in various statutory provisions, including the 1945 Constitution, Human Rights Act, Health Act, Mental Health Act, Health Minister Regulation, Minimum Service Standards for Health. Though there had not been any form of technical regulation related to health services for ODGJs, the regulation on ODGJs based on human rights principles would guarantee the protection the rights of ODGJs in getting health services.
