Abstract

Pinjaman online ilegal banyak diperbincangkan. Modus-modus pinjol yang menjebak korban juga semakin beragam. Yayasan Lembaga Konsumen Indonesia mencatat pengaduan tentang penyalahgunaan data pribadi merupakan salah satu yang paling banyak dilaporkan oleh masyarakat, baik secara langsung maupun tidak langsung. Pinjaman online ilegal, kerap disebut pinjol ilegal, kini kembali marak dengan modus beragam. Tujuan dari penulisan ini adalah untuk mengkaji perlindungan hukum terhadap data pribadi peminjam dalam layanan aplikasi pinjaman online. Metode yang digunakan dalam penulisan ini adalah metode hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan fakta. Hasil penelitian menemukan bahwa peminjaman melalui pinjol online ilegal tidak menghilangkan kewajiban pembayaran hutang pengguna, lalu juga terdapat hasil perbandingan di negara lain yang dapat diadopsi untuk mengatasi permasalahan pinjol ilegal ini. Kata Kunci : Pinjaman Online Ilegal (Fintech). / Illegal online loans are widely discussed. The pinjolmodes that trap the victim are also increasingly diverse. The Indonesian Consumers Foundation noted that complaints about misuse of personal data are among the most widely reported by the public, either directly or indirectly. Illegal online loans, often called illegal loans. The purpose of this paper is to examine the legal protection of borrowers' personal data in online loan application services. The method used in this paper is a normative legal method with an approach to legislation and a fact approach. The results of the Studi found that borrowing through illegal online lending does not eliminate the user's debt payment obligations, then there are also comparative results in other countries that can be adopted to overcome this problem of illegal borrowing.
