Abstract

Anak yang masih menjadi korban dari suatu tindak pidana pemerkosaan. pemerkosaan akan menyebabkan dampak trauma mendalam seumur hidup. Dampak tersebut meliputi masalah kesehatan dan psikis di kemudian hari, masalah trauma yang berkepanjangan bahkan sampai anak tersebut sudah dewasa. perlindungan hukum bagi anak yang menjadi korban dengan memberikan restitusi sesuai ,yang merupakan pemberian Restitusi tersebut merupakan amanah yang terdapat dalam Peraturan Pemerintah Nomor 43.Tahun2017 tentang Pelaksanaan Restitusi Bagi Anak Korban Yang Menjadi Korban Tindak Pidana.Pasal 81 Ayat (1) Undang-Undang RI NO.35 Tahun 2014 Tentang Perlindungan Anak.Penerapan Pidana Bagi Pelaku Pemerkosaan yang menjadi korban dari suatu tindak pidana pemerkosaan tersebut.Penelitian ini bertujuan untuk mengetahui apakah peraturan tentang restitusi sudah memenuhi restitusi terhadap anak atau belum dan penerapan pidana terhadap pelaku sesuai dengan rasa keadilan bagi korban. Metode Penelitian ini merupakan penelitian hukum normatif, dengan pendekatan kasus atau case approach . data yang digunakan data sekunder berupa bahan hukum primer primer yaitu perundang undangan dan putusan bahan hukum sekunder pendapat para ahli . Bahan Hukum Tertier, yaitu seperti kamus hukum, jurnal hukum, ensiklopedia, kemudian bahan hukum yang terkumpul disusun dan di analisis. Hasil penelitian menunjukkan bahwa Bahwa Pemenuhan Restitusi tersebut belum dalam hal ini didalam putusan tersebut tidak dibuat oleh majelis hakim.Penerapan Pidana terhadap Pelaku Tindak Pidana Pemerkosaan melanggar pasal 81 ayat (1) Jo Pasal 76 D dipidana dengan pidana penjara paling singkat 5(lima)tahun dan paling lama 15 (lima belas) tahun dan denda paling banyak Rp.5.000.000.000.00(lima miliar rupiah). Undang-Undang RI nomor 35 tahun 2014 tentang anak,tidak sesuai dengan perbuatan yang dilanggar pada pasal tersebut. / Children who are still victims of a criminal act of rape. rape will cause deep trauma for life. These impacts include health and psychological problems later in life, prolonged trauma problems even when the child is an adult. legal protection for children who are victims by providing appropriate restitution, which is the provision of restitution is a mandate contained in Government Regulation Number 43.Year 2017 concerning the Implementation of Restitution for Child Victims who are Victims of Crime. Article 81 Paragraph (1) of the Republic of Indonesia Law NO.35 of 2014 Concerning Child Protection. Criminal Application for Rape Perpetrators who are victims of a rape crime. This study aims to find out whether the regulations regarding restitution have fulfilled restitution for children or not and the application of punishment to perpetrators is in accordance with a sense of justice for victim. This research method is a normative legal research, with a case approach. the data used is secondary data in the form of primary legal materials, namely legislation and decisions of secondary legal materials opinions of experts. Tertiary Legal Materials, namely legal dictionaries, legal journals, encyclopedias, then the collected legal materials are compiled and analyzed. The results of the study show that the fulfillment of the Restitution has not yet been made, in this case the decision was not made by the panel of judges. Criminal Application of Rape Offenders violating Article 81 paragraph (1) Jo Article 76 D shall be punished with imprisonment for a minimum of 5 (five) years and a maximum of 15 (fifteen) years and a maximum fine of Rp. 5,000,000,000.00 (five billion rupiah). Republic of Indonesia Law number 35 of 2014 concerning children, is not in accordance with the actions that are violated in that article.
