Abstract

Tanah merupakan salah satu sumber daya alam yang banyak dimanfaatkan guna kebutuhan dasar manusia. Karena sangat pentingnya tanah bagi kebutuhan manusia, maka sangat diperlukan bukti otentik yaitu sertipikat tanah, sebagai bukti yang kuat untuk mencegah terjadinya sengketa. Semakin pesatnya perkembangan zaman sehingga sertipikat tanah manual akan dirubah menjadi sertipikat tanah elektronik. Rumusan masalah skripsi ini adalah Bagaimana kepastian hukum sertipikat tanah elektronik sebagai bukti kepemilikan hak atas tanah di Indonesia dan Bagaimana perlindungan hukum terhadap pemilik sertipikat tanah elektronik dalam menjamin keamanan data dari sertipikat tanah elektronik. Penulis menggunakan metode penelitian hukum normatif. Data yang digunakan dengan peraturan perundang-undangan, buku-buku, jurnal hukum, serta wawancara yang bersangkutan dengan permasalahan dalam penelitian ini. Dari hasil penelitian ini dapat disimpulkan bahwa setipikat tanah elektronik akan diterbitkan apabila terdapat permohonan dari pemohon untuk mengganti sertipikat tanah manual menjadi sertipikat tanah elektronik. Namun, pada BPN Jakarta Barat belum dilaksanakan penerapan sertipikat tanah elektronik. Sertipikat tanah elektronik ini harus terus di sosialisasikan, karena dalam era digitalisasi ini hampir semua aspek kehidupan mengikuti perkembangannya. Supaya penyelenggara negara dan layanan publik bisa menerapkan prinsip good corporate governance dengan pelaksanaan eGoverment. Kata Kunci: Kepastian Hukum, Sertipikat Tanah Elektronik, Kepemilikan Hak Atas Tanah. / Soil is natural resource that is widely used for basic human needs. Due to the important of land for human needs, authentic evidence is needed, namely land certificates, as solid evidence to pprevent disputes. The rapid development of the times so that manual land certificates will be changed to electronic land certificates. The formulation of the problem of this thesis is How is the legal standing of electronic land certificates as proof of ownership of land rights in Indonesia, and How is the legal protection for owner of electronic land certificates ensures data security from electronic certificates land. The author uses normative legal research methods. The data used are statutory regulations, books, legal journals, and interviews related to the problems in this study. From the results of this study, it can conclude that an electronic land certificate will be issued if there is a request from the applicant to change the manual land certificate to an electronic land certificate. However, the West Jakarta BPN still needs to implemented the application for electronic land certificate. This electronic land certificate must continue to be disseminated, because in this era of digitalization almost all aspects of life follow its development. So that state administrators and public services can apply the principles of good corporate governance by implementing e-Government.
